Does California’s Supreme Court have the authority to invalidate a proposition that “amends the constitution”?

Wednesday, October 8th, 2008 | Law & Ethics | 3 Comments

famous court case
Timothy H asked:

Obviously I’m interested because of Proposition 8, which passed. News reports are that people are asking the state to overturn Prop 8 because, even though it says that it amends California’s consitution, it violates the constitution’s “equal protection” clause.

So, is it clear whether the California Supreme Court has the authority to make such a decision? Is it unclear? Or, is it one of those deals like some of the famous US Supreme Court cases, where the California Supreme Court will essentially be ruling on what powers it does or does not have?

Where do first amendment rights end?

Dannilynn asked:

A jury in Baltimore just ordered the Westboro Baptist Church to pay the father of a slain soldier $11milion for picketing his funeral with signs reading things like “God hates fags” and “Hurray for dead soldiers.” The church doesn’t suggest that this particular soldier was gay, but believes that God is punishing the US for its tolerance of homosexuality.

Reminds me of the famous Supreme Court case looking at whether a Nazi spewing hatred in a Jewish neighborhood was still within his constitutional rights (they said no).
